What materials are related to the Brain Balance software according to the agreement?

- (h) COMPANY will, in its discretion, provide FRANCHISEE with modifications, additions, and deletions to the Software.
- 10.18. (a) FRANCHISEE's proposed Center location, relocation, center layout, office equipment, all printed matter used in the operation of the Franchised Business, including without limitation, assessment tools, tests, evaluation forms, stationery, signage, application forms, business cards, invoices, statements, and other materials, and the manner in which any and of these will be used are subject to the prior written consent of COMPANY and must comply with the Operations Manual.
- (j) FRANCHISEE is in breach of any of the terms or conditions of the Software Agreement;

- (b) COMPANY will provide FRANCHISEE with basic methods, assessment tools and tests to be used at the Standard Brain Balance Center location, protocols, and procedures for operating the Franchised Business and with customized software for operating the Brain Balance Program® and for capturing client statistical data for inclusion in the database.

What This Means (2025 FDD)
According to the 2025 Brain Balance Franchise Disclosure Document, Brain Balance may provide modifications, additions, and deletions to the software at its discretion. Prior to opening the franchised business, Brain Balance will provide franchisees with customized software for operating the Brain Balance Program and for capturing client statistical data for inclusion in the database.
Furthermore, the franchisee's proposed center layout and office equipment must comply with the Operations Manual. All printed matter used in the operation of the franchised business, including assessment tools, tests, evaluation forms, stationery, signage, application forms, business cards, invoices, statements, and other materials, must also comply with the Operations Manual.
Additionally, franchisees must adhere to the terms and conditions of the Software Agreement. A breach of the Software Agreement by the franchisee can be considered an event of default, potentially leading to the termination of the franchise agreement.
