What This Means (2025 FDD)
According to Brain Balance's 2025 Franchise Disclosure Document, a franchisee must sign the lease for their center within 120 days of executing the Franchise Agreement. Additionally, the franchisee must provide a copy of the fully executed lease to Brain Balance within ten days of signing it.
This requirement ensures that franchisees secure an appropriate location promptly after committing to the franchise. It also allows Brain Balance to maintain some control over the location selection and lease terms, as the lease requires prior written approval from Brain Balance and must contain provisions that permit assignment to Brain Balance and expressly provide that there are no obligations imposed on or granted against Brain Balance.
Furthermore, the franchisee is obligated to open the Brain Balance center within nine months of the date of the Franchise Agreement. This timeframe includes securing the location, completing the build-out, and fulfilling all other pre-opening requirements. Failing to meet these deadlines could potentially lead to penalties or termination of the agreement, as detailed elsewhere in the FDD.
