What This Means (2025 FDD)
According to Brain Balance's 2025 Franchise Disclosure Document, all permanent staff of a franchised Brain Balance business are required to sign a Confidentiality, Non-Solicitation, and Non-Compete Agreement. This agreement is outlined in Exhibit 3 and further detailed in the Operations Manual.
This requirement ensures that the franchisee takes necessary actions to protect Brain Balance's trade secrets and confidential information, both during the term of the Franchise Agreement and after its termination. The franchisee is responsible for ensuring that all permanent staff members execute this agreement.
Requiring employees to sign confidentiality and non-compete agreements is a common practice in franchising, particularly for businesses like Brain Balance that rely on proprietary systems, training methods, and confidential information. This measure helps maintain the integrity of the Brain Balance system and protects the brand's competitive advantage.
