ITEM 16 RESTRICTIONS ON WHAT THE FRANCHISEE MAY SELL
You must provide the Brain Balance Program® and the services specified in the Operations Manual or otherwise specified by us in writing. Your Brain Balance® Center may be used only to operate the Franchised Business and may not be used for any activity other than as specified in your Franchise Agreement and the Operations Manual. You must keep the Center open and in normal operation between 9:30 AM and 8:00 PM Monday through Friday, and on Saturday from 9:00 AM to 2:00 PM, or as BBF may specify in the Operations Manual or otherwise in writing. You must also refrain from using or permitting others to use your Center location for any
purpose other than the operation of your Franchised Business. You may not deliver any aspects of the Brain Balance program at a location outside of your center unless approved in writing. You must adhere to all standards, policies, and procedures in strict conformity with the specifications contained in the Franchise Agreement, Operations Manual, or other otherwise communicated by us in writing.
You will not offer certain services, including lead assessments, post program assessments, and administrative services at a Brain Balance® Satellite Center and you will instead perform those services at your standard Brain Balance Center.
We may modify the Brain Balance Program® and the Operations Manual in accordance with research and other developments. You must abide by any additions, deletions, and modifications we make, but only if the changes do not materially and unreasonably increase your obligations under the Franchise Agreement.

What This Means (2025 FDD)
According to the 2025 FDD, Brain Balance franchisees must adhere to the standards, policies, and procedures outlined in the Franchise Agreement, the Operations Manual, and other written communications from Brain Balance. The Operations Manual provides franchisees with the protocols and procedures for operating the franchised business. Brain Balance may modify the Brain Balance Program and the Operations Manual based on research and other developments.
Brain Balance franchisees are required to operate their centers within specific hours and can only use the center for the franchised business, unless otherwise approved in writing. Franchisees must also ensure that all permanent staff execute the Confidentiality, Non-Solicitation, and Non-Compete Agreement as provided in the Operations Manual.
Furthermore, franchisees need to obtain prior written consent from Brain Balance for various aspects of their business, including the center location, layout, office equipment, and all printed materials. All advertising and promotional materials must also be submitted for written approval before use. These stipulations ensure that franchisees maintain brand consistency and comply with Brain Balance's standards.
