Under what condition does the Boulder Designs franchise agreement become effective?

According to Boulder Designs' 2025 Franchise Disclosure Document, the franchise agreement becomes effective as of the "Effective Date." The agreement is binding upon the successors and assigns of the individual franchisee, their family members, ancestors, descendants, and collaterals. It also benefits the franchisee, its subsidiaries, successors, assigns, and Boulder Designs Franchising, LLC.

Furthermore, the franchisee must begin operating the franchised business within 180 days after the Effective Date. Failure to do so gives Boulder Designs the right to terminate the agreement, without refunding any amounts to the franchisee, if the franchisee does not correct the issue within 30 days.

Before opening the Boulder Designs business, the franchisee must fulfill several obligations, including furnishing copies of required insurance policies, completing initial training, hiring and training personnel, obtaining necessary permits and licenses, purchasing required inventory, ensuring ownership interest certificates are properly endorsed if the franchisee is a business entity, and paying all amounts due to Boulder Designs. By commencing operations, the franchisee acknowledges that Boulder Designs has fulfilled all obligations required prior to the opening of the business.
