TO THE FRANCHISE AGREEMENT
FRANCHISE DISCLOSURE QUESTIONNAIRE
NOTICE FOR PROSPECTIVE FRANCHISEES WHO RESIDE IN, OR WHO INTEND TO OPERATE THE FRANCHISED BUSINESS IN THE STATE OF CALIFORNIA, MARYLAND, OR WASHINGTON: DO NOT COMPLETE THIS QUESTIONNAIRE OR TO RESPOND TO ANY OF THE QUESTIONS IN THIS QUESTIONNAIRE.
As you know, Boulder Designs Franchising, LLC and you are preparing to enter into a Franchise Agreement for the operation of a Franchised Business. In this Franchisee Disclosure Questionnaire, Boulder Designs Franchising, LLC will be referred to as "Boulder Designs", "We" or "Us." The purpose of this Questionnaire is to determine whether any statements or promises were made to you that we did not authorize and that may be untrue, inaccurate or misleading.

What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, the purpose of the Franchisee Disclosure Questionnaire is for Boulder Designs to determine if any unauthorized, untrue, inaccurate, or misleading statements or promises were made to you. However, prospective franchisees who reside in, or who intend to operate the franchised business in the state of California, Maryland, or Washington, should not complete the questionnaire or respond to any of the questions in the questionnaire.
Section 24.5 of the franchise agreement states that the franchisee represents and acknowledges that they have not received or relied on any guarantee, express or implied, as to the revenues, profits, or likelihood of success of the franchised business. The franchisee also represents and acknowledges that there have been no representations by Boulder Designs' directors, managers, members, employees, attorneys, or agents that are not contained in, or are inconsistent with, the statements made in the Franchise Disclosure Document or the Franchise Agreement.
Section 24.6 states that the franchisee represents that their execution of the agreement will not violate any other agreement or commitment to which the franchisee or any owner is a party. Section 24.4 states that the franchisee represents it has conducted an independent investigation of the business contemplated by this Agreement and acknowledges that, like any other business, an investment in a Boulder Designs Business involves business risks and the success of the venture is dependent, among other factors, upon the business abilities and efforts of Franchisee.
