What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, franchisees are required to provide samples or photographs of advertising materials to Boulder Designs upon request. Specifically, franchisees must operate their franchised business so that it is clearly identified and advertised as a Boulder Designs business. This includes using the trademark "BOULDER DESIGNS" and other marks that are part of the system on all signs, paper supplies, business cards, uniforms, advertising materials, technology platforms, and other articles.
This requirement ensures that all advertising and promotional materials align with Boulder Designs' brand standards and trademark usage. By mandating the submission of samples or photographs, Boulder Designs maintains control over its brand image and ensures consistency across all franchise locations. This is a common practice in franchising, as it helps protect the brand's reputation and ensures that marketing efforts are aligned with the overall business strategy.
Furthermore, any advertising materials that a Boulder Designs franchisee submits for review become the property of Boulder Designs. Boulder Designs may use or distribute these materials as they deem appropriate without providing compensation to the franchisee. Boulder Designs also has the right to incorporate these materials into the system and disclose them to other franchisees or entities. This clause emphasizes that Boulder Designs retains control and ownership over advertising and marketing materials, allowing them to leverage successful campaigns across the franchise network.
