Is Boulder Designs obligated to provide compensation or finder's fees related to National Accounts?

According to Boulder Designs's 2025 Franchise Disclosure Document, franchisees are not entitled to compensation or finder's fees related to National Accounts. Specifically, Boulder Designs states that it does not offer any compensation or finder's fees for acquiring National Accounts, participating in them, or if another party fulfills National Account projects within a franchisee's territory.

The FDD outlines a National Accounts program where Boulder Designs may negotiate agreements to serve clients across multiple territories, often involving multiple franchisees. If a franchisee chooses to participate and an agreement is successfully completed in their territory, they will pay Boulder Designs 15% of the gross revenues received from the National Accounts projects assigned to them. Franchisees participating in the National Account program must provide products and services to all valid members of the National Account at the prices and terms required by Boulder Designs.

If a franchisee chooses not to participate in the National Accounts program or refuses a National Accounts project in their territory, Boulder Designs has the right to utilize another franchisee or assign the project to its affiliate. In such cases, the original franchisee is not entitled to any compensation, even if the services are provided within their territory. This policy is clearly stated to avoid any ambiguity regarding compensation for National Accounts activities.

An exception exists under the National Headstone Program, where Boulder Designs collects the project deposit and provides the franchisee with design, proof, and customer information. In this specific program, Boulder Designs keeps the project deposit, and the franchisee receives the remaining balance for the project. Gross revenue collected under the National Headstone Program is not subject to the 15% National Accounts Fee.
