Currently we require you to participate in a National Headstone Program, a Boulder Designs National Account for which we will collect a deposit due per project. Simultaneously with the execution of the franchise agreement, you must execute our National Headstone Program Agreement attached as Exhibit 11 to the franchise agreement. At the time of execution, you must pay a deposit and the deposit is based on template and materials selected by the customer and could vary based on the total project cost ("Project Deposit"). We will provide you with a design proof if one is available and the customer information, upon our receipt of the Project Deposit. Upon your acceptance of the project and completion you are entitled to
the remaining balance for the project and we will retain the Project Deposit paid to us for revenue generated inside and outside your Territory as a result of the lead provided by us and sale from the National Accounts projects assigned to you. In our sole discretion if we believe you are not capable of servicing the National Headstone Program customer, or if the volume of services exceed demand at the time, we may authorize other Boulder Designs franchisees or other qualified third-parties to provides the services and you will not be compensated for us or other franchisees providing services to the National Headstone Program customer within your Territory.

What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, franchisees are required to participate in a National Headstone Program, which is a Boulder Designs National Account. As part of this program, Boulder Designs collects a deposit for each project. Exhibit 11 to the franchise agreement is the National Headstone Program Agreement, which franchisees must execute simultaneously with the franchise agreement.
At the time of execution of the National Headstone Program Agreement, the franchisee must pay a Project Deposit. The amount of this deposit is based on the template and materials selected by the customer and can vary depending on the total project cost. Upon receipt of the Project Deposit, Boulder Designs will provide the franchisee with a design proof, if available, and the customer information.
Upon the franchisee's acceptance and completion of the project, they are entitled to the remaining balance, while Boulder Designs retains the Project Deposit. This deposit is considered revenue generated from the lead provided by Boulder Designs and the sale from the National Accounts projects assigned to the franchisee, regardless of whether the revenue was generated inside or outside the franchisee's territory. Boulder Designs retains the right to authorize other franchisees or qualified third parties to service the National Headstone Program customer if they believe the franchisee is not capable of doing so, or if the volume of services exceeds demand, without compensating the original franchisee.
