What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, the National Headstone Program is a National Account program that franchisees participate in, as detailed in Exhibit 11 of the Franchise Agreement. Boulder Designs has the right to solicit and obtain projects anywhere, including a franchisee's territory, and may offer these projects to the franchisee for execution.
The franchisee must service the National Headstone Program customer under the same terms, pricing, and provisions negotiated for the program, without additional compensation. The general procedure for servicing these customers is subject to the agreement and the Franchise Agreement, which Boulder Designs can change with 15 days' notice. Customers can design their headstones on the National Headstone Program webpage or contact Boulder Designs' design department for assistance. Once approved, Boulder Designs may collect a Project Deposit and provide design proof and customer information to the franchisee for construction.
The franchisee is responsible for communicating with the customer, completing the project per specifications, and sending a picture of the completed project for approval. The franchisee is also responsible for delivering and installing the product, with the option to charge the customer for these services. Boulder Designs may contact the customer to ensure satisfaction and provide a lifetime warranty, though they are not obligated to do so.
Boulder Designs collects a deposit per project, which varies based on the customer's selections, before sending the design proof and customer information to the franchisee. The franchisee receives the remaining balance after the project is completed, which is the gross revenue minus the Project Deposit. Boulder Designs retains the Project Deposit as a National Headstone Accounts Fee, which covers the costs of obtaining the project, maintaining the website, marketing, and administrative costs. The franchisee is responsible for any repair or replacement work and must complete it within 30 days, weather permitting. If the franchisee fails to do so, Boulder Designs may arrange for the repairs and charge the franchisee for the costs.
