Can Boulder Designs modify its specifications, standards, or requirements?

You may not sell any services, classes or products that we have not authorized in writing and you must discontinue offering any services, classes or products that we may disapprove within 30 days. Boulder Designs may modify any of its specifications, standards, or requirements as and when it deems necessary and you must promptly modify your operation or product lines accordingly. There are no limits on our right to do so. If we modify the System, you may be required to add or replace equipment, supplies, signs and fixtures.

What This Means (2025 FDD)
According to Boulder Designs's 2025 Franchise Disclosure Document, Boulder Designs retains the right to modify its specifications, standards, or requirements as it deems necessary. As a franchisee, you must promptly adapt your operations and product lines to align with these changes. The FDD states there are no limits on Boulder Designs's right to make such modifications.
These modifications to the Boulder Designs system may require franchisees to invest in new or replacement equipment, supplies, signs, and fixtures. Franchisees are responsible for covering these expenses. This is further detailed in Section 10.2, Modification of the System, where franchisees agree to make all required upgrades and modifications at their own expense within a reasonable time after receiving notice of such changes from Boulder Designs.
Boulder Designs also has the right to vary standards or specifications for test market purposes or for any franchisee based on specific qualifications, site peculiarities, trade area demographics, business potential, existing business practices, or any other condition it deems important for the successful operation of a particular Boulder Designs business. However, Boulder Designs is not obligated to extend similar variances to other franchisees.
Furthermore, Boulder Designs can make suggestions and give mandatory instructions regarding the operation of the franchise to ensure compliance with quality standards and protect the goodwill and image of the system. This includes the right to inspect the franchised business at reasonable times to ensure compliance with quality control and performance standards.
