What laws, regulations, and industry standards must the Boulder Designs franchisee's Computer Systems be compliant with?

Data Security and Privacy. Franchisee must comply with all applicable federal, state and local laws, rules, and regulations regarding data security, protection, and privacy, including, without limitation and if applicable, the California Consumer Privacy Act ("CCPA"), Cal. Civ. Code § 1798.100, et seq. Franchisee must comply with any privacy policies, data protection polices, and breach response policies that Franchisor periodically may establish. Franchisee must notify Franchisor immediately regarding any actual or suspected data breach at or in connection with the Franchised Business. Further, whenever and to the extent Franchisee operates as a "Service Provider" under the CCPA or in a similar capacity under any other applicable federal, state, or local privacy law, Franchisee represents, warrants, and covenants that:

According to Boulder Designs' 2025 Franchise Disclosure Document, franchisees must adhere to all applicable federal, state, and local laws, rules, and regulations concerning data security, protection, and privacy. This includes, but isn't limited to, compliance with the California Consumer Privacy Act (CCPA) if applicable.
Boulder Designs franchisees are also obligated to follow any privacy policies, data protection policies, and breach response policies that Boulder Designs may establish periodically. Franchisees are required to immediately notify Boulder Designs of any actual or suspected data breaches related to the franchised business. Furthermore, if a franchisee operates as a "Service Provider" under the CCPA or a similar capacity under other privacy laws, they must represent, warrant, and covenant that they will comply with those laws.
In addition to data security and privacy laws, Boulder Designs franchisees are responsible for protecting themselves from disruptions such as Internet access failures, content failures, and attacks by hackers. They waive any claims against Boulder Designs or its affiliates resulting from such disruptions. Franchisees are also responsible for providing notices of breach or compromise and monitoring credit histories and transactions of customers, unless otherwise directed by Boulder Designs. These measures ensure the protection of customer data and the integrity of the Boulder Designs brand.
