What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, the landlord acknowledges that the tenant is a Boulder Designs franchisee and that the franchised business operates at the premises under the Boulder Designs franchise system, according to the franchise agreement between the tenant and Boulder Designs. The landlord consents to the tenant's use of Boulder Designs' marks and signs, decor items, color schemes, and related components of the Boulder Designs system as prescribed for the business. During the term of the Franchise Agreement, the premises may only be used for the operation of the business.
This clause ensures that the landlord is aware of and approves the franchisee's use of Boulder Designs' branding elements at the business location. This is crucial for maintaining brand consistency and ensuring that the franchisee can properly represent the Boulder Designs brand. It also restricts the use of the premises to only the Boulder Designs business during the franchise term, preventing any conflicting or unapproved business activities from taking place at the same location.
For a prospective Boulder Designs franchisee, this means that the lease agreement will include a provision where the landlord explicitly consents to the use of Boulder Designs' trademarks and signage. This helps avoid potential disputes with the landlord regarding branding and ensures that the franchisee can operate the business in accordance with Boulder Designs' standards. It is important for franchisees to review this section of the lease agreement carefully to understand their rights and obligations regarding the use of Boulder Designs' branding at the premises.
