Will a Boulder Designs franchisee receive additional compensation for participating in the National Headstone Program?

Franchisee further acknowledges and agrees that pursuant to the Franchise Agreement, if Franchisor obtains a National Headstone Program project in the Territory, Franchisor may, but is not obligated to, offer the project to Franchisee for execution and completion. If Franchisor makes such an offer, Franchisee agrees to service the National Headstone Program customer under the same terms, pricing, and provisions negotiated for the National Headstone Program, and the Franchisee shall not receive any additional compensation for participation in the National Headstone Program.

What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, franchisees will not receive additional compensation for their participation in the National Headstone Program. If Boulder Designs offers a National Headstone Program project to a franchisee within their territory, the franchisee must service the customer under the same terms, pricing, and provisions negotiated for the National Headstone Program.
Boulder Designs may solicit and obtain projects located anywhere, including a franchisee's territory, through the National Headstone Program. The franchisee acknowledges that Boulder Designs has incurred significant costs in developing the national website and marketing services related to the National Headstone Program. If a franchisee refuses to service a customer lead generated through the National Headstone Program, and later services that client for products or services offered under the program, the franchisee is responsible for paying Boulder Designs a commission of 50% of gross revenue. Boulder Designs also retains the right to terminate the agreement or franchise agreement at its sole discretion.
Boulder Designs retains the right to authorize other franchisees or qualified third parties to provide services within a franchisee's territory if the franchisee is not capable of servicing the customer or if the volume of services exceeds demand. In such cases, the franchisee is not entitled to compensation for services provided by Boulder Designs or other franchisees to the National Headstone Program customer within their territory. The franchisee is responsible for providing any repair or replacement work for National Headstone Program customers they service, covering the costs of materials, overhead, and labor to meet Boulder Designs' standards.
