When must a Boulder Designs franchisee execute the National Headstone Program Agreement?

Currently we require you to participate in a National Headstone Program, a Boulder Designs National Account for which we will collect a deposit due per project. Simultaneously with the execution of the franchise agreement, you must execute our National Headstone Program Agreement attached as Exhibit 11 to the franchise agreement. At the time of execution, you must pay a deposit and the deposit is based on template and materials selected by the customer and could vary based on the total project cost ("Project Deposit"). We will provide you with a design proof if one is available and the customer information, upon our receipt of the Project Deposit. What This Means (2025 FDD)
According to Boulder Designs' 2025 Franchise Disclosure Document, franchisees are required to participate in the National Headstone Program, which is a National Account managed by Boulder Designs. The FDD specifies that a prospective Boulder Designs franchisee must execute the National Headstone Program Agreement simultaneously with the execution of the franchise agreement. This agreement is included as Exhibit 11 to the franchise agreement.
At the time of execution, the franchisee must also pay a Project Deposit. The amount of this deposit varies based on the template and materials selected by the customer and is dependent on the total project cost. Boulder Designs will provide the franchisee with a design proof, if available, and customer information upon receipt of the Project Deposit.
Upon the franchisee's acceptance and completion of the project, they are entitled to the remaining balance, while Boulder Designs retains the Project Deposit. This deposit covers revenue generated both inside and outside the franchisee's territory as a result of leads provided by Boulder Designs and sales from National Accounts projects assigned to the franchisee. Boulder Designs retains the right to authorize other franchisees or qualified third parties to provide services if they believe the franchisee is not capable of servicing the National Headstone Program customer or if the service volume exceeds demand.
