What This Means (2025 FDD)
According to Boulder Designs's 2025 Franchise Disclosure Document, Boulder Designs states that it is not aware of any effective determinations from the U.S. Copyright Office or any court regarding its copyrighted materials. Boulder Designs claims copyright protection in its Manual, website, and other copyrightable items that are part of its System.
Boulder Designs specifies that franchisees must only use these copyrighted items as instructed and must stop using them if directed to do so. Franchisees are prohibited from duplicating or disclosing any portion of the Manual in an unauthorized manner, as all information is proprietary and must be kept confidential according to the Franchise Agreement.
Boulder Designs also states that its right to use or license copyrighted items is not materially limited by any agreement or known infringing use, except as otherwise stated in the FDD. This means that Boulder Designs believes it has the right to use and license its copyrighted materials without significant restrictions, based on its current understanding.
Prospective franchisees should be aware that they are strictly limited in how they can use Boulder Designs's copyrighted materials and must adhere to the franchisor's guidelines. Any unauthorized use or disclosure could result in a breach of the Franchise Agreement.
