When can Bor Restoration conduct a criminal background check on a franchisee?

c. As part of the grant of this Franchise Agreement, you agree that you will be subject to an initial credit and criminal background check before you sign. You further agree that we have the right to recheck your credit and criminal background at any time during the Term (or any Successor Franchise term) of this Franchise Agreement. You agree to and will sign the release that is attached as Exhibit 3.

What This Means (2024 FDD)
According to Bor Restoration's 2024 Franchise Disclosure Document, Bor Restoration conducts criminal background checks on franchisees at two specific times. First, Bor Restoration will conduct an initial criminal background check before you sign the Franchise Agreement. Second, Bor Restoration has the right to recheck your criminal background at any time during the term (or any successor franchise term) of the Franchise Agreement.
As a condition of being considered as a franchise candidate, you must consent to Bor Restoration obtaining your criminal conviction history from any law enforcement agency, criminal background service provider, municipality, state, or the FBI. This includes arrest and conviction data, plea bargains, deferred adjudication, as well as social security verification and driving history.
If a criminal background check during the term of the franchise agreement discloses any material change in your status, it may result in the termination of your franchise with Bor Restoration. Bor Restoration will keep the background check release form on file for the term of the franchise agreement and for a period of two years following its termination for any reason.
