What This Means (2024 FDD)
According to Bor Restoration's 2024 Franchise Disclosure Document, Bor Restoration does assign an "Exclusive Territory" to franchisees before they open their business. This is part of the pre-opening assistance that Bor Restoration provides. The specifics of the Exclusive Territory are further detailed in Item 12 and Article 1 of the Franchise Agreement.
This Exclusive Territory has implications for where a franchisee can operate. The FDD states that the franchisee's home, which serves as the Franchised Location, must be within the assigned Exclusive Territory. This means franchisees are expected to operate primarily from their home within their designated area.
Furthermore, Bor Restoration requires franchisees to focus their local advertising efforts within their Exclusive Territory. Franchisees must spend the greater of $1,500 or 5% of Gross Sales each month on local advertising, and this advertising must be targeted within their Exclusive Territory. Bor Restoration retains the right to increase this amount to no more than 6% or $2,000 after providing 60 days' written notice. Additionally, Bor Restoration may require franchisees to purchase internet advertising for their Exclusive Territory from search engines like Google, Bing, or Yahoo.
