What This Means (2025 FDD)
Based on the 2025 Bonchon Franchise Disclosure Document, franchisees are generally responsible for all charges related to Windstream services. The document outlines the terms and conditions for Windstream services, stating that the customer, in this case the franchisee, is responsible for all permissible taxes, surcharges, fees, and assessments that apply to the services. This includes any changes to these charges in the future, regardless of whether they are specified in the agreement.
Furthermore, the Bonchon franchisee is liable for all charges if Windstream or a third-party provider needs to extend the demarcation point, if installation is delayed due to the franchisee, or if special construction is required. Windstream retains the right to modify monthly recurring charges with at least thirty days' notice and other rates at any time.
In summary, the FDD does not explicitly state any circumstances under which Bonchon would be required to pay for Windstream services on behalf of the franchisee. The franchisee bears the responsibility for all costs associated with these services, including potential increases or additional charges due to specific circumstances related to the installation or service requirements.
