6.05 Construction of Your Bonchon Restaurant
After acquiring the Restaurant Location of your Bonchon Restaurant by lease or purchase, you shall at your expense, and as applicable, either construct your Bonchon Restaurant at the Restaurant Location, or convert the existing premises at the Restaurant Location to become your Bonchon Restaurant, in conformity with the final plans and specifications which we have approved (as provided in Section 6.04). At your expense and prior to commencing construction of your Restaurant, you must obtain all necessary permits, licenses, variances and approvals pertaining to the building, occupancy, signs, utilities, zoning, use, and any other permits, approvals or variances which are necessary to permit the construction and use of a Restaurant as may be required by federal, state and local laws, rules, regulations or ordinances.
Bonchon will designate an architect and a general contractor whose services you will be required to retain, at your own expense, for the development and construction of your Restaurant.
- (a) If you would like to use an alternative architect, then you must submit to us (i) (for our approval) the name of your proposed architect and any other information that we may require to assess whether your proposed architect meets our then-current standards and specifications; and (ii) the Architect Evaluation Fee. The Architect Evaluation Fee is payable at the time you submit your request to use an alternate architect and is nonrefundable. Bonchon will review and communicate its decision as to whether your request is approved or rejected within three (3) weeks of the date that you submit all the information that we need to evaluate your proposed architect. If we do not respond to your request in the allotted timeframe, then you are prohibited from using the proposed architect.
- (b) If you would like to use an alternative general contractor, then you must submit to us (i) (for our approval) the name of your proposed general contractor and any other information that we may require to assess whether your proposed architect meets our then-current standards and specifications; and (ii) the General Contractor Evaluation Fee. The General Contractor Evaluation Fee is payable at the time you submit your request to use an alternate general contractor and is nonrefundable.

Based on the 2025 Bonchon Franchise Disclosure Document, the franchisee is responsible for obtaining all necessary permits, licenses, and approvals related to utilities. Bonchon designates an architect and a general contractor that the franchisee is required to retain at their own expense for the restaurant's development and construction.
Prior to starting construction, the franchisee must obtain all necessary permits, licenses, variances, and approvals for building, occupancy, signs, utilities, and zoning. This includes any other permits, approvals, or variances required by federal, state, and local laws to allow the construction and use of the restaurant.
Bonchon will not be responsible for delays in construction, conversion, remodeling, equipping, or decoration, nor for any loss resulting from the restaurant's design or construction. The franchisee must get Bonchon's written approval for all changes to the restaurant's plans before implementing them. Bonchon and its designees have the right to access the restaurant location while work is in progress and may require reasonable modifications to the construction.
The franchisee is responsible for maintaining the interior and exterior of the franchised Bonchon restaurant, including the parking lot and walkways, in first-class condition and repair, complying with all applicable laws, rules, regulations, and Bonchon's manuals. This maintenance is at the franchisee's sole expense, unless Bonchon expressly agrees otherwise in writing.
