What This Means (2025 FDD)
According to Bonchon's 2025 Franchise Disclosure Document, if the franchise is terminated or expires, the franchisee is subject to a non-competition covenant. This covenant restricts involvement in any competing business for a period of 2 years. The geographic scope of this restriction includes the franchisee's Development Territory.
Additionally, the non-compete extends to a 20-mile radius around the perimeter of the franchisee's Development Territory. It also encompasses a 20-mile radius around the perimeter of, or within, any existing Bonchon business. This includes company-owned, franchised, or otherwise established and operated Bonchon locations.
It is important to note that these non-competition covenants are subject to state law, which may affect their enforceability. Prospective franchisees should carefully review Section 11.01 of the Area Development Agreement, as referenced in the FDD, and consult with legal counsel to understand the specific implications and restrictions in their state.
