What This Means (2025 FDD)
According to Bonchon's 2025 Franchise Disclosure Document, the Area Development Fee is not refundable under any circumstances. If a franchisee enters into an Area Development Agreement to develop and operate two or more Bonchon restaurants, they must pay an Area Development Fee. This fee is equal to the Initial Franchise Fee for the first Bonchon restaurant, plus a $10,000 deposit for each subsequent restaurant they are required to develop, own, and operate. This deposit will be applied against the Initial Franchise Fee for each respective Bonchon restaurant.
Bonchon states that the Area Development Fee is fully earned when paid. This means that once the franchisee pays the fee, Bonchon has earned it and is under no obligation to return it, regardless of whether the franchisee successfully opens all of the agreed-upon restaurants. This is a standard practice in franchising, as the franchisor incurs costs in evaluating and setting up the area development agreement.
Prospective franchisees should carefully consider their ability to meet the development schedule and financial obligations before entering into an Area Development Agreement with Bonchon, given that the Area Development Fee is non-refundable. Franchisees should also be aware that Bonchon uses these fees to cover expenses related to the sale and establishment of franchises, including costs related to developing and improving their services, preparing the Disclosure Document, legal and accounting fees, and the costs of obtaining and screening franchisees.
