Under a Bojangles Development Agreement, what options are granted to the franchisee regarding restaurant locations?

The Development Agreement will grant you either an Assigned Area within which to establish and operate your Restaurants at specific locations to be designated in separate Franchise Agreements or at specific locations at which you may operate Restaurants under the authority of specific Franchise Agreements. The Individual Franchise Agreement and Bojangles Express Franchise Agreement when not associated with a Development Agreement will grant you an assigned location to be determined under procedures established in each of those agreements for the establishment and operation of your Restaurant.
You must propose, before your acquisition by lease or purchase of any site, the site for a Restaurant for our approval on forms or in the manner that we designate. You may submit a site to us only after you have carefully evaluated the site, determined that it meets the criteria for Restaurant sites which we have communicated to you, and determined that you may acquire or lease it. If we do not approve a site you submit, you will not be permitted to develop a Restaurant on the site. We will review your application for site approval, and, within 45 days of our receipt of your application, we will either approve or reject the proposed site in our sole discretion with comments concerning the reasons for rejection if applicable. If you do not obtain our approval of a site prior to the site approval deadline in the Franchise Agreement (if you have signed a Franchise Agreement) and the Development Agreement, we have the right to terminate the Franchise Agreement and Development Agreement. For Individual Franchise Agreements and Bojangles Express Franchise Agreements not associated with a Development Agreement, the franchisee is granted an assigned location determined under procedures established in each of those agreements.
Before acquiring a site, the franchisee must propose the site to Bojangles for approval, ensuring it meets the criteria communicated by Bojangles. If Bojangles does not approve a submitted site, the franchisee cannot develop a restaurant there. Bojangles will review the site application and approve or reject it within 45 days, providing comments for rejection if applicable. Failure to obtain site approval by the deadline in the Franchise Agreement and Development Agreement can result in termination of both agreements.
Bojangles considers several factors when reviewing sites, including population around the location, traffic counts, signage availability, visibility, ease of access, speed limits, parking, traffic flow, building elevations, demographics, nearby traffic generators like shopping centers and hospitals, population and commercial growth, and potential impact on existing Bojangles restaurants. If the site is approved under a Development Agreement, Bojangles will send a site approval letter, after which the franchisee will receive the current disclosure document, Franchise Agreement, and related documents, which must be signed within 30 days of receipt.
