Can Bojangles require franchisees to comply with price restrictions in connection with Special Promotions and Multi-Channel Programs?

Bojangles Franchise · 2025 FDD

Answer from 2025 FDD Document

We may also require you to participate in multi-channel marketing platforms approved by us (the "Multi-Channel Programs") to further promote Bojangles and the Bojangles System. The Multi-Channel Programs will require your cooperation and participation, including for you to refrain from certain channels of marketing and distribution, and to pay commissions or referral fees. We will designate the multi-channel platform, method and timing of payment, and any outside agencies for the Multi-Channel Programs. To the extent permitted by applicable law, you will comply with any price restriction that we may promulgate in connection with the Special Promotions and the Multi-Channel Programs.

What This Means (2025 FDD)

According to Bojangles's 2025 Franchise Disclosure Document, franchisees may be required to comply with price restrictions during Special Promotions and Multi-Channel Programs, provided it is permitted by applicable law. Bojangles may introduce Special Promotions to promote the brand, and franchisees are required to implement Bojangles's requirements for these promotions, bearing all associated costs. Bojangles may also require franchisees to participate in Multi-Channel Programs, which may involve refraining from certain marketing channels and paying commissions or referral fees. Bojangles will designate the platform, payment method, timing, and any outside agencies for these programs.

This means that as a Bojangles franchisee, you might not have complete control over pricing during promotional periods or through specific marketing channels. You will need to factor in the costs of participating in these promotions and programs, which could impact your profit margins. It is important to stay informed about the specific requirements and restrictions associated with these promotions and programs to ensure compliance and avoid potential penalties.

Franchisors commonly implement promotional strategies and marketing programs to maintain brand consistency and drive sales across the franchise system. However, franchisees should carefully evaluate the potential impact of price restrictions and participation costs on their individual business profitability. Prospective franchisees should discuss with Bojangles the details of these programs, including the frequency, duration, and expected costs, to fully understand their obligations and potential financial implications.
