What This Means (2025 FDD)
According to Bojangles's 2025 Franchise Disclosure Document, a Designated Market Area (DMA) can employ an advertising agency or individual to handle advertising functions, but the employment period cannot exceed one year. To extend the employment beyond this one-year term, a vote of 51% of the DMA Membership is required, with members present and voting at an annual or special meeting.
This means that Bojangles franchisees participating in a DMA have the flexibility to hire advertising support, but they must regularly re-evaluate these arrangements. The need for a majority vote ensures that the DMA members collectively agree on the value and performance of the advertising agency or individual. This also allows the DMA to adapt its advertising strategy and personnel as needed.
For a prospective Bojangles franchisee, this indicates that involvement in the DMA includes active participation in decisions regarding advertising. Franchisees should be prepared to attend meetings, voice their opinions, and vote on matters such as the hiring and retention of advertising agencies. This structure aims to balance the need for consistent advertising support with the DMA's ability to make changes based on the needs and preferences of its members.
It's worth noting that the franchisor, Bojangles, retains control over the overall marketing strategies and guidelines, ensuring that all DMA advertising aligns with the brand's standards. Franchisees should be aware of these requirements and understand that any advertising created by or for the DMA is subject to the franchisor's approval and must adhere to the brand's guidelines.
