How many days after Bojangles' written site approval notice does the franchisee have to commence construction of the Bojangles Restaurant?

According to Bojangles' 2025 Franchise Disclosure Document, a franchisee must commence construction of their Bojangles restaurant within 270 days after the date of Bojangles' written site approval notice. This deadline is referred to as the "Construction Commencement Deadline."

Strict compliance with this deadline is essential to the franchise agreement. Failure to meet the Construction Commencement Deadline constitutes a material, non-curable breach of the agreement. This gives Bojangles the right to immediately terminate the agreement by providing written notice to the franchisee.

However, a franchisee can submit a written request to Bojangles for an extension of up to six months of the Construction Commencement Deadline. The franchisee must pay Bojangles a lump-sum extension fee of $2,500 when submitting the extension request to compensate Bojangles for its costs, expenses, and lost opportunities related to the proposed extension. Bojangles must receive the extension request at least 14 calendar days before the deadline. Bojangles has sole discretion to grant or reject the extension request. If Bojangles rejects the extension request, the extension fee will be refunded to the franchisee.
