Answer from 2025 FDD Document

You must propose, before your acquisition by lease or purchase of any site, the site for a Restaurant for our approval on forms or in the manner that we designate. You may submit a site to us only after you have carefully evaluated the site, determined that it meets the criteria for Restaurant sites which we have communicated to you, and determined that you may acquire or lease it. If we do not approve a site you submit, you will not be permitted to develop a Restaurant on the site. We will review your application for site approval, and, within 45 days of our receipt of your application, we will either approve or reject the proposed site in our sole discretion with comments concerning the reasons for rejection if applicable. What This Means (2025 FDD)

According to Bojangles's 2025 Franchise Disclosure Document, if Bojangles does not approve a proposed site for a restaurant, the franchisee will not be permitted to develop a restaurant at that location. Bojangles will review the site application and either approve or reject it within 45 days of receipt, providing comments for the rejection if applicable.

If a franchisee signs a Franchise Agreement or Development Agreement, there is a site approval deadline. Failure to obtain site approval by this deadline gives Bojangles the right to terminate both the Franchise Agreement and the Development Agreement. Bojangles considers factors such as population, traffic, signage, visibility, ease of access, speed limits, parking, traffic flow, demographics, nearby traffic generators (shopping centers, schools, hospitals), population and commercial growth, and potential impact on existing Bojangles restaurants when reviewing potential sites.

This stipulation highlights the importance of thorough site evaluation and adherence to Bojangles's criteria before formally proposing a location. Franchisees should carefully consider these factors to increase the likelihood of site approval and avoid potential termination of their agreements. The 45-day review period offers a relatively quick turnaround, but the franchisee bears the risk of potential delays or rejection if the site does not meet Bojangles's standards.
