How should a Bojangles franchisee propose sites for approval by the Franchisor?

Franchisee shall propose sites for approval by Franchisor on forms or in the manner designated from time to time by Franchisor. A site shall only be submitted to Franchisor after Franchisee has carefully evaluated the site and determined that it meets the criteria for Restaurant sites which Franchisor has communicated to Franchisee. Franchisor shall review the application for site approval; and within forty-five (45) days of Franchisor's receipt of the application, Franchisor shall approve the proposed site or reject the site with comments as to why it was rejected. Franchisor reserves the right to reject any site proposed by Franchisee if Franchisee or its affiliates (or any beneficial owner(s) of Franchisee or its affiliates): fail to demonstrate adequate financial resources and operational readiness to develop the site and operate the Restaurant, including adequate sources of capital; are not in good standing under this Agreement, any other agreements between Franchisee or its affiliates (or any beneficial owner(s) of Franchisee or its affiliates) and Franchisor or its affiliates; or fail to adhere to any manuals, policies and/or procedures implemented by Franchisor in connection with other agreements between Franchisor and Franchisee or its affiliates (or any beneficial owner(s) of Franchisee or its affiliates), including without limitation as related to operational standards.

What This Means (2025 FDD)
According to Bojangles's 2025 Franchise Disclosure Document, a franchisee must propose sites for approval using the forms or methods that Bojangles designates. Before submitting a site, the franchisee must carefully evaluate it to ensure it meets the criteria for restaurant sites that Bojangles has communicated.
Bojangles will then review the application for site approval. Within 45 days of receiving the application, Bojangles will either approve the proposed site or reject it, providing comments explaining the reasons for rejection.
Bojangles reserves the right to reject a proposed site if the franchisee or its affiliates do not demonstrate adequate financial resources and operational readiness, are not in good standing under any agreements with Bojangles, or fail to adhere to Bojangles's manuals, policies, and procedures.
