What This Means (2025 FDD)
According to Bojangles's 2025 Franchise Disclosure Document, in addition to general liability insurance, franchisees must name specific entities as additional insureds or loss payees on all insurance policies. These entities include Bojangles Opco, LLC, and Bojangles' Restaurants Inc., in its capacity as Manager under a Management Agreement with Bojangles Opco, LLC.
Furthermore, the franchisee must also include the respective affiliates, successors, and assigns of Bojangles Opco, LLC, and Bojangles' Restaurants Inc. The list extends to their respective partners, officers, directors, shareholders, agents, representatives, and employees. This requirement ensures that a broad range of related parties are protected under the franchisee's insurance coverage.
This stipulation is a standard practice in franchising, designed to protect the franchisor and its related parties from potential liabilities arising from the franchisee's operations. Franchisees must also ensure that their insurance policies cannot be canceled without providing thirty days prior written notice to Bojangles. Copies of all notices related to the insurance policies must also be sent to Bojangles, ensuring the franchisor stays informed about the franchisee's insurance coverage.
