What agreement is entered into simultaneously with the execution of the Development Agreement for a Bojangles franchise?

According to Bojangles's 2025 Franchise Disclosure Document, an addendum to the Bojangles Development Agreement is entered into simultaneously with the execution of the Development Agreement. This addendum is made between Bojangles OPCO, LLC, referred to as "Franchisor," and the "Developer." The addendum modifies the Development Agreement to allow the Developer to receive benefits from the Equipment Reimbursement Incentive Program offered by Bojangles.

The Equipment Reimbursement Incentive Program is designed to encourage the development of franchised Bojangles restaurants. To be eligible for the program, the developer must meet specific conditions, including signing the Development Agreement by December 31, 2025, and developing at least three new restaurants. The developer cannot participate in other incentive programs or receive other monetary concessions from Bojangles or its affiliates. If multiple development agreements are signed simultaneously, the program applies only to the agreement with the most store commitments.

Under the program, a "Qualifying Restaurant" is defined as the first and second new Bojangles restaurants opened by the developer in the assigned area within four years of the Development Agreement's effective date. Bojangles will reimburse the developer up to $300,000 for equipment costs for each Qualifying Restaurant, payable within thirty days after the restaurant's opening and receipt of satisfactory invoices. The developer must also comply with Bojangles's site approval process and execute the standard Equipment Reimbursement Incentive Program Addendum to the Franchise Agreement.
