Does Body Brain Center use confidentiality clauses with franchisees?
Body_Brain_Center Franchise · 2025 FDDAnswer from 2025 FDD Document
During the last three fiscal years, we have signed confidentiality clauses with some current and former franchisees. In some instances, current and former franchisees sign provisions restricting their ability to speak openly about their experience with us. You may wish to speak with current and former franchisees, but be aware that not all such franchisees will be able to communicate with you. There are no: (i) trademarkspecific franchisee organization associated with the franchise system offered that we have created, sponsored or endorsed; or (ii) independent franchisee organizations that have asked to be included in this Disclosure Document.

What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, Body Brain Center has used confidentiality clauses with both current and former franchisees. The FDD states that some current and former franchisees have signed agreements that limit their ability to speak openly about their experiences with Body Brain Center. This means that a prospective franchisee may not get a complete or unbiased view when speaking with current and former franchisees, as some may be restricted in what they can share.
This practice is relatively common in franchising, as franchisors often seek to protect their brand reputation and trade secrets. However, it's important for potential franchisees to be aware of this limitation when conducting their due diligence. It may be beneficial to seek out franchisees who are not bound by such agreements or to rely on other sources of information, such as industry reports or franchise consultants, to get a more comprehensive understanding of the Body Brain Center franchise system.
Prospective franchisees should consider asking Body Brain Center about the scope and enforceability of these confidentiality clauses. Understanding the specific restrictions and the number of franchisees affected can help in assessing the potential impact on their ability to gather information and make an informed decision. Additionally, it would be prudent to consult with an attorney to fully understand the legal implications of these clauses.
