Is Body Brain Center required to create a franchise advisory council?
Body_Brain_Center Franchise · 2025 FDDAnswer from 2025 FDD Document
FRANCHISE ADVISORY COUNCIL**.
We may, but need not, create a franchise advisory council to provide us with suggestions to improve the System, including matters such as advertising, marketing, operations and new service suggestions.
We will consider all suggestions from the advisory council in good faith, but we are not bound by any such suggestions.
The advisory council will be established and operated according to rules and regulations we periodically approve, including procedures governing the selection of representatives of the advisory council who will communicate with us on matters raised by the advisory council.
You will have the right to be a member of the advisory council as long as you are not in default under this Agreement and you do not act in a disruptive, abusive or counterproductive manner, as determined by us in our discretion.
As a member, you will be entitled to all voting rights and privileges granted to other members of the council.
Each member will be granted one vote for each Body & Brain Center that it owns and operates on all matters on which members are authorized to vote.

What This Means (2025 FDD)
According to the 2025 Body Brain Center Franchise Disclosure Document, Body Brain Center is not required to create a franchise advisory council. The FDD states that Body Brain Center may choose to establish one, but it is not obligated to do so. The purpose of such a council would be to provide suggestions for improving the Body Brain Center system, covering areas like advertising, marketing, operations, and new service ideas.
If Body Brain Center does establish a franchise advisory council, it will consider all suggestions in good faith, but the franchisor is not bound by any of the council's recommendations. The advisory council's structure and operation would be governed by rules and regulations approved by Body Brain Center, including the selection process for representatives who will communicate with the franchisor.
Franchisees in good standing have the right to be a member of the advisory council, provided they are not in default under their Franchise Agreement and do not act disruptively. As a member, a franchisee would have voting rights, with one vote granted for each Body & Brain Center they own and operate. This structure allows franchisees to potentially influence the direction of the Body Brain Center system, but ultimately, Body Brain Center retains control over whether to implement any suggested changes.
