What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, if a franchisee wishes to transfer their franchise, the transferee must meet Body Brain Center's qualifications. The transferee must successfully complete the initial training program, which includes paying the initial training fee. Additionally, the transferee must obtain all required licenses and permits and sign a new franchise agreement for the remainder of the term.
Furthermore, the franchisee must be in compliance with their existing Franchise Agreement. If applicable, they must assign their lease to the transferee. The franchisee is also required to pay Body Brain Center the transfer fee and sign a general release and subordination agreement.
Finally, Body Brain Center must notify the franchisee that they do not intend to exercise their right of first refusal to acquire the business. The Software Service Agreement also stipulates that the franchisee must obtain Body Brain Center’s approval in writing to transfer the franchise.
