What This Means (2025 FDD)

According to the 2025 Body Brain Center Franchise Disclosure Document, the 'Premises' refers to the physical location where the franchisee will operate the Body & Brain franchised business. Specifically, it is the location that the Tenant/Franchisee leases as described in Exhibit A of the lease agreement. This definition is part of the Lease Addendum, which is an attachment to the Franchise Agreement.

For a prospective Body Brain Center franchisee, understanding the definition of 'Premises' is crucial because it identifies the physical space from which they will conduct their business. The franchisor must approve this site, and it must meet the franchisor's minimum site selection criteria. The franchisee is responsible for locating and securing the premises, subject to Body Brain Center's approval.

Furthermore, if leasing, the franchisee must try to get the landlord to sign the Lease Addendum. If the landlord refuses to sign, Body Brain Center has the right to disapprove the lease, potentially requiring the franchisee to find a new location. After securing the premises, the franchisee is responsible for constructing and equipping it according to the specifications in the Body Brain Center manual. The layout of the center must also be approved before opening, ensuring it aligns with the brand's standards.
