Answer from 2025 FDD Document

Music

You may only play the music that we authorize from time to time relating to the operation of your Business. We do not offer licensing for any particular music, that must be obtained through Performance Rights Organizations, such as ASCAP, BMI or SESAC. However, the music played at Body and Brain locations is an important aspect of brand continuity, so we require franchisees to get advanced authorization of music.

What This Means (2025 FDD)

According to the 2025 Body Brain Center Franchise Disclosure Document, Body Brain Center does not offer music licensing to its franchisees. While franchisees must play authorized music to maintain brand continuity, they are responsible for obtaining the necessary licenses from Performance Rights Organizations like ASCAP, BMI, or SESAC. This means that franchisees will need to independently secure and pay for the appropriate music licenses to legally play music in their Body Brain Center locations.

This requirement places the onus on the franchisee to ensure they are compliant with copyright laws regarding music usage. Failure to obtain the proper licenses could result in legal repercussions for the franchisee. It is common practice in the franchise industry for franchisors to provide guidance or pre-approved music playlists to help franchisees navigate these requirements, but the ultimate responsibility for licensing typically falls on the franchisee.

Prospective Body Brain Center franchisees should factor in the costs associated with obtaining music licenses when evaluating the overall investment. They should also inquire with Body Brain Center about any specific guidelines or recommendations for music selection and licensing to ensure they meet the brand's standards and legal requirements. Understanding these obligations upfront will help franchisees avoid potential legal issues and maintain a consistent brand experience for their customers.
