- 7.3 Construction. After you purchase or sign the lease for your premises, you must construct and equip the premises to the specifications contained in the Manual and purchase (or lease) and install the equipment, fixtures, signs and other items that we require. You acknowledge these requirements are necessary and reasonable to preserve the identity, reputation and goodwill we developed and the value of the franchise. Before you open, we must approve the layout of your Center.
- 7.4 Opening. You must open your Center to the public within two (2) years after the Effective Date. We may, in our sole and absolute discretion, grant you an opening date extension period; provided however, that (i) you must request an extension at least 30 days before the expiration of the initial two-year opening period;

What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, after Body Brain Center approves the location for the new franchise, the franchisee must purchase or sign the lease for the premises. Following this, the franchisee is obligated to construct and equip the premises according to the specifications outlined in the Body Brain Center manual. This includes purchasing or leasing and installing all required equipment, fixtures, and signs. Before opening the Body Brain Center to the public, the franchisee must obtain Body Brain Center's approval of the center's layout.
If the franchisee leases the premises, they must make their best effort to ensure that the landlord signs the Lease Addendum attached to the Franchise Agreement. If the landlord refuses to sign the Lease Addendum in substantially the form provided, Body Brain Center reserves the right to disapprove the lease, and the franchisee will need to find a new site for their center.
The franchisee is expected to open their Body Brain Center to the public within two years of the Effective Date of the franchise agreement. These requirements are in place to maintain the consistency and standards of the Body Brain Center brand, ensuring that each location reflects the established identity, reputation, and goodwill of the franchise.
