If either of us fails to appoint a Qualified Appraiser within the 30-day period, the appraisal shall be made by the sole Qualified Appraiser appointed within that period.

What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, if either the franchisor or franchisee fails to appoint a Qualified Appraiser within 30 days after the Appraisal Date, the appraisal of the Body & Brain Center will be conducted by the single Qualified Appraiser who was appointed within that 30-day period. The Appraisal Date is defined as the effective date of the termination or expiration of the Franchise Agreement.
This means that if only one party appoints an appraiser in time, that appraiser's valuation will be the sole basis for determining the fair market value of the Body & Brain Center if the franchisor elects to purchase the center. The fair market value will be used if Body Brain Center chooses to purchase the franchisee's Body & Brain Center upon termination or expiration of the franchise agreement.
