Must the franchisor approve the terms of the lease before a Body Brain Center franchisee signs it?

We also must approve the terms of your lease before you sign it. You must use your best efforts to cause your landlord to sign the Lease Addendum that is attached to the Franchise Agreement as Attachment "C". We will approve or reject the lease within 10 business days after we receive it (together with the Lease
Addendum agreed to by your landlord). The scope of our review islimited to ensuring that the lease includes certain provisions that are designed for our protection (particularly the provisions included in the Lease Rider). We do not review the substantive terms, quality or merits of your lease. If your landlord refuses to sign the Lease Addendum in substantially the form attached to the Franchise Agreement, we may require that you find a new site for your Center.

What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, franchisees must have the franchisor approve the terms of their lease before signing. Body Brain Center will either approve or reject the lease within 10 business days after receiving it, along with a Lease Addendum agreed to by the landlord.
The scope of Body Brain Center's review is limited to ensuring that the lease includes specific provisions designed for their protection, particularly those in the Lease Rider. They do not review the substantive terms, quality, or merits of the lease itself.
If a landlord refuses to sign the Lease Addendum in the form attached to the Franchise Agreement, Body Brain Center may require the franchisee to find a new site for their Center. Securing an approved location is critical, as failure to do so within two years of signing the Franchise Agreement (or any approved extension) constitutes an event of default, potentially leading to termination of the franchise agreement.
