As a Body Brain Center franchisee, what are you expected to independently operate?

We hereby grant you a license to own and operate a Body & Brain Center (your "Business" or your "Center") using our Intellectual Property from a single location that we approve in writing.
You must hire, train, and supervise honest, reliable, competent and courteous employees for the operation of your Business.
You must pay all wages, commissions, fringe benefits, worker's compensation premiums and payroll taxes (and other withholdings required by law) due for your employees.
These employees will be employees of yours and not of ours.
You must ensure that a sufficient number of trained employees are available to meet the operational standards and requirements of your Business at all times.
You must ensure that your employees perform their duties in compliance with the terms of the Manual and any other materials applicable to employees that we communicate to you.
You may give your employees only the minimum amount of information and material from the Manual that is necessary.
You must ensure that your employees do not make or retain any copies of the Manual or any portion of the Manual.
We do not control, or have the right to control, the hiring, firing, training, discipline or day-to-day activities of your employees.
You agree to locate and obtain our approval of the premises from which you will operate your Business.

What This Means (2025 FDD)
According to the 2025 Body Brain Center FDD, as a franchisee, you are granted a license to own and operate a Body & Brain Center, referred to as your "Business" or "Center", utilizing Body Brain Center's intellectual property from a single, approved location. This operation includes hiring, training, and supervising employees who will be under your employment, not Body Brain Center's. You are responsible for paying their wages, commissions, benefits, and all applicable payroll taxes.
The FDD emphasizes that you must ensure a sufficient number of trained employees are available to meet the operational standards of your Body & Brain Center at all times. These employees must perform their duties in compliance with the Body Brain Center's operating manual and any other guidelines provided. However, you are only allowed to share the minimum necessary information from the manual with your employees, and you must prevent them from making or retaining copies of it.
Furthermore, the FDD states that Body Brain Center does not control or have the right to control your employees' hiring, firing, training, discipline, or day-to-day activities. This underscores your role as an independent business owner responsible for all aspects of your staff's management and performance within the framework of the Body Brain Center system. You are also responsible for locating the premises from which you will operate your Business, and obtaining Body Brain Center's approval of the site.
