your employees. These employees will be employees of yours and not of ours. You must ensure that a sufficient number of trained employees are available to meet the operational standards and requirements of your Business at all times. You must ensure that your employees perform their duties in compliance with the terms of the Manual and any other materials applicable to employees that we communicate to you. You may give your employees only the minimum amount of information and material from the Manual that is necessary. You must ensure that your employees do not make or retain any copies of the Manual or any portion of the Manual. We do not control, or have the right to control, the hiring, firing, training, discipline or day-to-day activities of your employees.
9. ADVERTISING & MARKETING
9.1 Advertising Fund.

According to the 2025 Body Brain Center Franchise Disclosure Document, franchisees are responsible for ensuring their employees meet specific obligations. Franchisees must ensure that their employees perform their duties in compliance with the terms of the Body Brain Center Manual and any other applicable materials communicated by the franchisor. Additionally, franchisees must limit the information and materials from the Manual given to employees to only what is necessary for their duties.
Furthermore, Body Brain Center franchisees must ensure their employees do not make or retain any copies of the Manual or any portion thereof, protecting the franchisor's confidential operating procedures. Franchisees are also responsible for ensuring that all employees who may have access to Body & Brain Center's Know-how sign and send a Brand Protection Agreement before accessing it. Franchisees must then use their best efforts to ensure that these individuals comply with the terms of the Brand Protection Agreements and must immediately notify the franchisor of any breach that comes to their attention.
These stipulations highlight the importance Body Brain Center places on maintaining brand standards and protecting proprietary information. Franchisees bear the responsibility of actively managing their employees' access to and use of confidential materials, as well as enforcing compliance with the Brand Protection Agreement. Failure to adequately oversee employee conduct could expose the franchisee to liability and potentially damage the Body Brain Center brand.
