If either (i) you fail to sign the Franchise Agreement on or prior to the expiration of the Franchise Evaluation Period or (ii) you fail to successfully complete the training program, we shall have no obligation to offer you a franchise and we may keep the training fee in consideration of the training we provided to you.
Further, if you do not sign the Franchise Agreement or you fail to successfully complete the training program, you understand that you must still comply with all of the terms of this Agreement.

What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, if a franchisee or their manager fails to successfully complete the initial training program, Body Brain Center is not obligated to offer a franchise agreement. Furthermore, Body Brain Center is allowed to retain the initial training fee of $10,000 as compensation for the training provided. The franchisee must still adhere to the terms of the agreement, even if training is not successfully completed or a Franchise Agreement is not signed.
Additionally, if an owner or manager fails the initial training program, they must retake the training and pay a retraining fee of $400 for each attempt. This fee is non-refundable and must be paid before attending the retraining session. This policy applies uniformly to all Body Brain Center franchisees.
The initial training program is essential, as a Body & Brain Center cannot open until at least one owner has successfully completed the training program. This ensures that the franchisee is adequately prepared to operate the business according to Body Brain Center's standards. The training program consists of approximately 30 hours over 5 to 9 days and takes place at a retreat in Sedona, Arizona, Ellenville, New York, or another location selected by Body Brain Center, or in an online format.
