What This Means (2025 FDD)
According to the 2025 Body Brain Center Franchise Disclosure Document, "Copyrights" are defined as the protected works and materials that Body & Brain or its affiliates own, and which franchisees are allowed to use for marketing and operating their Body & Brain Centers. This includes materials that exist now or are created in the future. In simpler terms, these are the items like training manuals, marketing brochures, and website content that are legally protected by copyright law, ensuring that only Body & Brain and its franchisees can use them.
For a prospective franchisee, this means they will have the right to use these copyrighted materials to promote and run their center. However, it's important to understand that Body & Brain retains ownership of these copyrights. Franchisees must adhere to the guidelines and standards set by Body & Brain when using these materials. Unauthorized use of these copyrighted materials could lead to legal issues and potential termination of the franchise agreement.
Body Brain Center also has the right to modify these Copyrights at any time in its sole and absolute discretion. If Body Brain Center modifies or discontinues use of any of the Copyrights, then the franchisee must comply with any such instructions within 30 days at their own cost. This means that the franchisee needs to stay updated with any changes to the copyrighted materials and be prepared to adapt their marketing and operational strategies accordingly.
