You agree to comply with all of the provisions in this Section 5, even if you fail to sign a Franchise Agreement during the Franchise Evaluation Period.
If you sign a Franchise Agreement during the Franchise Evaluation Period, the provisions in this Section 5 will not apply to you after you sign the Franchise Agreement and the terms of the Franchise Agreement will supersede the terms of this Agreement.
