What This Means (2025 FDD)
According to Body Brain Center's 2025 Franchise Disclosure Document, a franchisee must meet several conditions to be eligible for a successor franchise agreement. The franchisee must provide written notice of their intent to renew not less than 180 days nor more than 360 days before the current term expires. At the time of sending the renewal notice and signing the new agreement, the franchisee must not be in default of the existing agreement or any other agreement with Body Brain Center or its affiliates.
Additionally, the franchisee must sign the current form of the franchise agreement and all associated documents required by Body Brain Center. A general release must also be signed, which typically waives any claims against the franchisor up to that point. A renewal fee of $1,000 is required, which is non-refundable once the successor agreement is signed. Finally, the franchisee must take any additional action that Body Brain Center reasonably requires at the time of renewal.
These renewal terms are important for prospective franchisees to consider. The new franchise agreement may have terms and conditions, including financial and territorial terms, that differ significantly from the original agreement. The renewal term can be either three or five years, chosen at the franchisee's option, but the total term, including the initial and renewal terms, cannot exceed 15 years. After 15 years, renewal is at Body Brain Center's sole discretion. Franchisees should be aware of these conditions and the potential for changes in the franchise agreement upon renewal.
