What This Means (2025 FDD)
According to Body20's 2025 Franchise Disclosure Document, the questionnaire included in the agreement is not applicable in certain states due to their franchise disclosure laws. Specifically, the questionnaire is not to be completed, and will not apply, if the offer or sale of the Body20 franchise is subject to the state franchise disclosure laws in California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, or Wisconsin.
This means that if a prospective Body20 franchisee is located in or will be operating the franchise in one of these listed states, they are not required to complete the questionnaire before signing the Franchise Agreement. The purpose of the questionnaire is to confirm that the franchisee understands the terms of the contract and that no unauthorized statements or promises have been made. However, these states have their own franchise laws in place to protect franchisees, making the questionnaire redundant.
It is important for prospective franchisees to be aware of this provision, especially if they are presented with the questionnaire despite being located in one of the listed states. Franchisees should also note that if the franchise is to be operated in, or they are a resident of, Maryland, they should not sign the acknowledgement. This highlights the importance of carefully reviewing the FDD and any state-specific riders to understand the specific requirements and protections applicable in their jurisdiction.
