What This Means (2025 FDD)
According to Body20's 2025 Franchise Disclosure Document, the receipt includes a question asking if you understand all the information contained in the FDD. Specifically, the questionnaire asks, "Do you understand all of the information contained in the FDD?" with options to answer "Yes" or "No". If you answer "No", you are prompted to specify which parts of the FDD you do not understand, with space provided to attach additional pages if necessary.
This requirement ensures that prospective Body20 franchisees have reviewed and comprehended the FDD before entering into a franchise agreement. It serves as a checkpoint to identify any areas of confusion or misunderstanding, allowing the franchisee to seek clarification from Body20 or an advisor. This process aims to promote informed decision-making and reduce the likelihood of future disputes arising from a lack of understanding of the franchise terms.
However, the FDD also states that in certain states, including California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, or Wisconsin, any questionnaire signed by the franchisee cannot waive claims under state franchise law or disclaim reliance on statements made by Body20. This provision is designed to protect franchisees in these states from unknowingly relinquishing their legal rights.
Furthermore, a separate compliance questionnaire attached as Exhibit J to the FDD is not applicable if the franchise is to be operated in or if you are a resident of the states listed above. This compliance questionnaire is designed to confirm that the franchisee understands the terms of the contract and that no unauthorized statements or promises have been made. This indicates that Body20 takes extra steps to ensure compliance and understanding, but these steps may vary depending on the location of the franchise.
