If Body20 grants an extension, does that extension apply to all Studios under the Development Schedule?

Answer from 2025 FDD Document

Any extension that we grant you (or your Affiliated Entity) will apply only to the Studios for which you (or your Affiliated Entity) obtained the extension and will not extend, delay, or otherwise impact any other deadline under the Development Schedule.

What This Means (2025 FDD)

According to Body20's 2025 Franchise Disclosure Document, any extension granted by Body20 applies strictly to the specific studios for which the extension was obtained. This means that if a franchisee is developing multiple Body20 studios under a development schedule, an extension for one studio does not automatically extend or impact the deadlines for any other studios in the schedule. Each studio's deadlines and obligations are treated separately in this regard.

This policy has significant implications for Body20 franchisees with multi-unit development agreements. Franchisees must manage their development timelines carefully for each location, as delays in one project will not excuse or delay the requirements for others. This necessitates meticulous planning and resource allocation to ensure each studio meets its designated signing and opening deadlines. The franchisee cannot assume that leniency granted for one location will apply across the board.

Body20 may, at its discretion, extend any Signing Deadline or any Opening Deadline, which it may condition on the franchisee's payment of an Extension Fee and execution of a general release. The Extension Fee for each Studio will be $2,500 per month (or portion of a month) that the Signing Deadline or Opening Deadline for such Studio is extended. This highlights the importance of franchisees maintaining open communication with Body20 regarding any potential delays and understanding the specific terms and conditions associated with any extension.

In the event that a franchisee is unable to execute a Franchise Agreement by the Signing Deadline because Body20 is unable to timely deliver a required Franchise Disclosure Document, Body20 will adjust such Signing Deadline and Opening Deadline for the applicable Studio to take into consideration the date on which they were able to provide the Franchise Disclosure Document, without requiring payment of an Extension Fee or the execution of a general release.
