What This Means (2025 FDD)
According to the 2025 Body20 Franchise Disclosure Document, the franchisee acknowledges having the opportunity to discuss the FDD, related agreements, and the benefits and risks of operating a Body20 franchise with an attorney, accountant, or other professional advisor. The franchisee must indicate whether they have had such discussions. If they have, they must provide the name and profession of the advisor. If they have not, they must indicate whether they wish to have more time to do so.
This acknowledgement is part of a compliance questionnaire that Body20 requires franchisees to complete before signing the Franchise Agreement. The questionnaire aims to confirm that the franchisee understands the terms of the contract and that no unauthorized statements or promises have been made. However, this questionnaire does not apply if the franchise is to be operated in, or the franchisee is a resident of, California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington, or Wisconsin.
This requirement ensures that prospective Body20 franchisees are fully informed and have sought independent advice before committing to the franchise. It protects both the franchisee and the franchisor by documenting that the franchisee had the opportunity to seek professional counsel and understood the risks and benefits involved. This is a standard practice in franchising, as it promotes transparency and reduces the likelihood of future disputes arising from misunderstandings or misrepresentations.
