What This Means (2025 FDD)

According to Body20's 2025 Franchise Disclosure Document, Body20 has the option to employ a regional advertising agency for its marketing efforts. The document states that Body20 may produce marketing materials in-house or employ a local, regional, or national advertising agency. However, Body20 is not obligated to conduct any advertising or marketing programs within a franchisee's specific market.

This means that while Body20 franchisees may benefit from the expertise of a regional advertising agency employed by the franchisor, there is no guarantee that the franchisor will conduct any advertising in the franchisee's local market. The franchisee is responsible for local marketing, and all advertising materials using Body20's marks must receive prior written approval from Body20. If approval is not received within 14 days, the material is considered disapproved, and Body20 reserves the right to require the franchisee to discontinue the use of any advertising or marketing materials.

Body20 also details that franchisees must spend a minimum of $1,500 per month on local advertising and promotional activities, which is in addition to the Brand Fund Fee. Failure to meet this spending requirement may result in Body20 requiring the franchisee to pay the shortfall as an additional Brand Fund Fee or for Body20 to use the funds for local marketing on the franchisee's behalf. Additionally, franchisees must participate in advertising cooperatives if Body20 establishes or approves them, which may require additional marketing expenditures.
