What This Means (2025 FDD)
According to Black Bear Diner's 2025 Franchise Disclosure Document, the franchisor retains all rights related to the website, franchisee's website or web page, and any intranet/extranet system. This includes all rights to the data stored within these systems. Black Bear Diner also has the authority to alter or terminate the website, franchisee's web page, or the intranet/extranet system.
This means that as a franchisee, you do not own or control the Black Bear Diner website or any related online systems. While you may have a franchisee-specific page or access to the intranet, the franchisor ultimately has the right to modify or shut down these resources. This is a fairly standard practice in franchising, as it allows the franchisor to maintain brand consistency and control over the online presence.
Furthermore, Black Bear Diner has the right to access all information and data contained on its website, including any franchisee's separate website or web page that is part of the franchisor's website, and any intranet/extranet system. Franchisee conduct on the website, intranet/extranet system, or other online communications, including the use of marks or advertising, is subject to the franchise agreement. Franchisees must also acknowledge that certain information related to their participation in the website or any intranet/extranet system may be considered confidential, including access and identification codes. This underscores the importance of adhering to the franchisor's standards and guidelines when engaging in any online activities related to the Black Bear Diner brand.
